1. Acceptance of Terms

By accessing and using Zimam, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Who operates Zimam

Zimam is operated by Zimam LLC, a limited liability company formed in New Mexico, United States, with its registered office at 1209 Mountain Road Pl NE, Ste N, Albuquerque, NM 87110. We are not currently registered as a legal entity in Algeria, and the service is operated from the United States. You can reach us about these terms at [email protected].

3. Description of Service

Zimam provides a platform for merchants to build and manage online stores, specifically optimized for growth in the MENA region with localized features and delivery integrations. We provide the software. We are not the seller of the goods offered through your store, we are not party to the sale between you and your customer, and we do not take possession of the goods.

4. User Obligations

Users are responsible for maintaining the confidentiality of their account information and for all activities that occur under their account. You agree to provide accurate and complete information.

5. Your obligations as a merchant

You are the merchant of record for everything you sell through your store. You are responsible for holding any commercial registration, tax registration, licence or authorisation that the law of your own country requires for the goods you sell and the way you sell them, for the accuracy of your product and price information, and for meeting your customers' legal rights, including any right of return or refund. Where local law requires an e-commerce seller to be registered or to publish particular information, meeting that requirement is yours, not ours.

6. Payment and Subscriptions

Service fees are based on the selected subscription plan. Subscription fees are charged in advance for the period you select and are non-refundable for the period already begun, except where a mandatory law that applies to you provides otherwise. We reserve the right to modify our pricing with notice.

7. Intellectual Property

All content and technology provided by Zimam remains our exclusive property. Users retain ownership of the content they upload to their own storefronts.

8. Limitation of Liability

Zimam shall not be liable for any indirect, incidental, or consequential damages resulting from the use or inability to use our services. Nothing in these terms limits liability that cannot be limited under a mandatory law that applies to you.

9. Governing Law and disputes

These terms are governed by the laws of the State of New Mexico, United States, without regard to its conflict of law rules. The state and federal courts located in New Mexico shall have exclusive jurisdiction over any dispute arising out of these terms. This choice does not remove any right you have under a mandatory law of your own country that applies to you regardless of this agreement, including consumer protection and personal data protection law.

10. Changes to these terms

We may update these terms. When we make a material change we will give notice through the dashboard or by email before it takes effect. Continuing to use Zimam after a change takes effect means you accept the updated terms.
